Supreme Court dismisses injunction application against CJ removal process

The Supreme Court has, in a close 3-2 majority decision, dismissed an application filed to halt the ongoing process for the removal of Chief Justice Gertrude Torkornoo and to revoke her suspension from office.

The application was filed by Vincent Ekow Assafuah, Member of Parliament for Old Tafo, and represented in court by former Attorney General Godfred Yeboah Dame.

Acting Chief Justice Paul Baffoe-Bonnie, together with Justices Yonny Kulendi and Amadu Tanko, formed the majority that voted to dismiss the injunction.

Justices Henrietta Mensah Bonsu and Ernest Gaewu dissented, siding with the applicant.

The Court announced that its full judgment and reasoning will be delivered on May 21, 2025.

Chief Justice Torkornoo was suspended by President John Dramani Mahama on April 22, following the establishment of a prima facie case against her.

The action was prompted by petitions submitted by private citizen Daniel Ofori, senior police officer Ayamga Akolgo, and civic group Shining Stars of Ghana.

A five-member investigative committee has since been formed to probe the allegations.

Assafuah’s injunction, filed before the petitions were formally referred to the Council of State, sought to bar the President from forwarding the complaint to the Chief Justice for a response.

That attempt has now been blocked by the Supreme Court’s ruling, allowing the removal process to proceed.
