Supreme Court indefinitely adjourns case against removal of Chief Justice

In a latest development, the Supreme Court has postponed indefinitely an application seeking to suspend the proceedings that could potentially lead to the Chief Justice’s removal.

This request was made by Vincent Ekow Assafuah, the Member of Parliament for Old Tafo, who is seeking a temporary injunction to halt the impeachment process until a ruling is made on his writ challenging the constitutionality of the actions taken.

At the court on Wednesday, April 9, 2025, a five-judge panel, led by Justice Henrietta Mensa-Bonsu, announced the adjournment following a request from the Office of the Attorney-General.

Justice Mensa-Bonsu shared that the Attorney-General had formally asked for a postponement of all cases involving their office for the week due to a conference for State Attorneys taking place in Accra.

While the panel was already informed about this, State Attorney Reginald Odoi attended the court to emphasise the request from the Attorney-General personally, showing respect for the court.

Mr. Odoi conveyed that the Attorney-General wanted to bring this to the court’s attention directly.

However, the applicant’s counsel, Godfred Yeboah Dame, a former Attorney-General himself, raised concerns about the absence of the Attorney-General or any deputy at what he described as “an important constitutional case” in light of the conference.

He remarked, “It is quite odd that a conference of state attorneys should lead to the adjournment of such an important case”.

He urged the court to reschedule the matter to the soonest date, ideally Monday. Nevertheless, the court clarified that it lacked the authority to set a new date since the Attorney-General’s request was directed specifically to the Chief Justice.

“The case will go back to the Chief Justice for her to fix a new date since it was a request to her office. Case is therefore adjourned sine die,” Justice Mensa-Bonsu ruled.
