Cecilia’s case: OSP heads to Supreme Court over recent High Court ruling

The Office of the Special Prosecutor (OSP) has filed a certiorari at the Supreme Court challenging a recent High Court ruling in Cecilia Dapaah’s case.

A writ of certiorari is a legal mechanism by which a higher court reviews a lower court’s decision.

This legal procedure allows the higher court to review and potentially overturn the lower court’s decision, thereby ensuring uniformity and consistency in the interpretation and application of the law.

It will be recalled that the Accra High Court had approved an expedited hearing request by the former sanitation minister in the freezing and seizure of assets motion case before it.

The ruling by the High Court judge Justice Edward Twum did not sit well with the OSP, thus the current motion before the apex court.

Additionally, the OSP has also filed a stay of application pending the review motion before the apex court.

The legal team of Cecilia Dapaah, however, accused the OSP of orchestrating a plan to delay or avoid the hearing of the various applications before the High Court.

They argued that this plan was causing injury to their client and infringing upon her economic rights.

Ms. Dapaah’s court hurdles began when seven persons, including her house help, were hauled before the court for stealing $1 million,  €300,000, and other valuables from her residence.

The Office of the Special Prosecutor (OSP) subsequently filed a motion to freeze her bank accounts and monies recovered after searching her residence.

Aside from the funds in her accounts, US$590,000 and over GH¢2.730,000 were also recovered from her residence on July 24.

The Accra High Court is yet to decide whether Special Prosecutor Kissi Agyebeng can continue to hold Mrs Dapaah’s seized cash, which he has described as possibly tainted.
