Contempt suit against EC Chairperson and deputies dismissed

The High Court in Tema has struck out a contempt suit filed against the Electoral Commission (EC) Chairperson, Jean Mensa and her two deputies.

Ayitah Precious, a private citizen,  filed a motion at the court seeking, among other things, a declaration that the decision of the EC to restrict the limited voter registration exercise to its 268 district offices was unlawful and a violation of the applicant’s fundamental human rights and freedoms guaranteed under the constitution.

However, while the application was still pending, the EC went ahead with the exercise, prompting the applicant to file a contempt application on September 12.

She prayed the court to find the EC chairperson and her deputies, Dr. Bossman Eric Asare and Samuel Tettey, guilty of contempt.

Her application also urged the court to jail the EC officials.

Meanwhile, counsel for the EC, Justine Amenuvor, argued that neither the commission nor the respondents stated in the suit were duly served with the proceedings relied on for the instant application by the applicant.

The counsel said the application is without basis per the applicant’s own search conducted at the registry of the court and attached to the application as Exhibit “AP5”.

After hearing the parties, the presiding judge, Justice Patricia Quansah, dismissed the application, saying it was without proper service.

She also slapped the applicant with a cost of GH¢ 2000.00.

Meanwhile, the substantive matter, which had become moot, had been withdrawn.
