Suit Against Mahama Is Dead On Arrival – Legal Practitioner

A private legal practitioner, Alexander Kodwo Kom Abban, says the suit against former President John Dramani Mahama by Kenneth Agyei Kuranchie to stop the former from contesting in the 2024 general elections is dead on arrival.

He was of the view that although the 1992 constitution does not permit the former president to indulge in any other work, contesting for presidency in other elections is allowed.

Addressing the issue in an interview monitored by The Ghana Report on 3FM, Kodwo Kom Abban said, “The suit against former President John Mahama is dead on arrival”.

On Tuesday, June 13, there was a report on the Managing Editor of the Daily Searchlight, Kenneth Agyei Kuranchie, filing a legal case against former president John Dramani Mahama on his decision to contest as the presidential candidate for the National Democratic Congress(NDC) in the 2024 general elections.

The reliefs Kenneth Agyei Kuranchie is seeking include:

“A declaration that on a true and proper interpretation of Article 66 (1) of the 1992 Constitution, the number of years of a presidential term in Ghana is four years.

“A declaration that upon a true and proper interpretation of Article 66 (1) and (2) of the 1992 Constitution, a person seeking a second presidential term must be a sitting president”.

“An order directed at [John Mahama] to fully disclose to Parliament the terms of his engagements with Parliament as flagbearer of a political party.”
